On 26 April 2023, Amnesty International submitted a third-party intervention to the European Court of Human Rights (ECtHR) in the case of C.O.G.G and Others v Lithuania. Amnesty International’s written submissions focus on Article 3 of the European Convention of Human Rights and the principle of non-refoulement, and analyse the impact of relevant legislation, policies and practices introduced by the Lithuanian government since 2021. The written submissions also engage with ECtHR case-law and demonstrate how the Court’s jurisprudence stemming from N.D. and N.T. v. Spain can be subjected to abusive usages by states seeking to circumvent Article 4 Protocol 4 obligations.
