This briefing focuses on the shortcomings of the new law introducing the crime of torture in the Italian legal system; on violations of the prohibition of refoulement; on the de facto complicity or participation of Italian authorities in the torture and cruel, inhuman or degrading treatment of refugees and migrants in Libya as a result of its cooperation with Libyan authorities on border control; and on the failure to investigate and remedy allegations of torture and other ill-treatment against asylum-seekers and migrants during identification procedures.
