This report examines the human rights issues associated with the right to seek international protection in the United States, particularly the use of the CBP One mobile application. On 11 May 2023, the Biden Administration introduced the Circumvention of Lawful Pathways Final Rule (also known as the Asylum Ban). The Final Rule imposes a rebuttable presumption of ineligibility for asylum upon individuals who enter the United States from Mexico at the southern land border or adjacent coastal borders “without authorization”.
