What is the problem?

Imprisoned for peaceful protest.

Luis Pacheco and Héctor Chaclán, ancestral authorities of the 48 Cantons of Totonicapán in 2023, were arrested on 23 April 2025 for participating in peaceful protests.

They have been accused of terrorism, unlawful association and obstruction of criminal proceedings, charges that could mean decades in prison. These accusations are based on their role as community authorities, despite them carrying out legitimate duties according to their traditions.

The use of charges like terrorism against those who protest peacefully reflects a pattern of criminalization against indigenous authorities and defenders in Guatemala, and represents an attack on the right to peaceful protest.

Amnesty International declared Luis and Héctor prisoners of conscience on 6 May 2026, because they are being detained solely for peacefully exercising their rights. Their case has suffered delays and irregularities, and over a year later, they remain in pre-trial detention.
