«Nous sommes solidaires de la société civile en Hongrie»

Plus de 250 organisations et plateformes du monde entier ont signé une lettre pour faire part de leur vive préoccupation face à l’espace de plus en plus restreint pour la société civile en Hongrie. Voici cette lettre :

Le 13 février 2018, le gouvernement hongrois a présenté au Parlement un pack législatif comprenant trois projets de loi, communément appelé « Stop Soros ». Ces nouveaux textes de loi restreindraient encore davantage la possibilité pour la société civile hongroise de faire son travail, en exigeant des organisations qui « soutiennent l’immigration » qu’elles obtiennent un avis favorable des services de sécurité et une autorisation gouvernementale pour mener à bien leurs activités de base.

Aux termes de ces nouvelles lois, les organisations devraient par ailleurs s’acquitter d’une taxe de 25 % sur tout financement en provenance de l’étranger destiné à « soutenir l’immigration », sous peine de s’exposer à des mesures extrêmement sévères. Les amendes exorbitantes risqueraient de provoquer leur faillite, puis leur dissolution.

En tant que défenseurs des droits et des libertés, nous souhaitons que les citoyens du monde entier puissent s'exprimer sans être agressés, menacés ni incarcérés.

Ces propositions s’inscrivent dans un contexte où la société civile en Hongrie a déjà perdu beaucoup de latitude et sont contraires à l’obligation de la Hongrie, aux termes du droit international, de protéger les droits à la liberté d’association et d’expression ainsi que le droit de circuler librement.

Nous pensons que ces projets de loi représentent la dernière initiative du gouvernement hongrois dans le cadre de sa politique visant à réprimer le travail légitime des organisations de la société civile, qui s’efforcent de promouvoir et défendre les droits humains, fournissent des services légaux et sociaux à ceux qui en ont besoin à travers le pays, et expriment publiquement des opinions dissidentes dans la presse ou sur Internet.

En tant que défenseurs des droits et des libertés, nous souhaitons que les citoyens du monde entier puissent s’exprimer sans être agressés, menacés ni incarcérés. Un débat ouvert sur les questions liées aux politiques et aux pratiques gouvernementales est nécessaire dans toute société et les défenseurs des droits humains ne devraient pas être poursuivis en justice parce qu’ils expriment des opinions parfois dissidentes.

Les États doivent adopter et appliquer des lois qui protègent les défenseurs des droits humains et doivent renoncer aux lois répressives qui visent à réduire au silence ceux qui osent s’exprimer.

Les défenseurs des droits humains défendent les droits des membres de leurs communautés et des citoyens de leurs pays, et par là même protègent tous nos droits, dans le monde entier. Ils sont bien souvent la dernière ligne de défense d’une société libre et juste, au prix de risques personnels énormes et de grands sacrifices.

Ce sont des personnes courageuses, mobilisées pour créer une société plus juste. Sans leur courage, notre monde serait moins juste, moins équitable, moins égalitaire.

Nous demandons au Parlement hongrois de rejeter les projets de loi dans leur globalité et de laisser les ONG et les défenseurs poursuivre leur travail, au lieu de les obliger à se défendre contre de telles attaques.
