On 17 November 1996 the Israeli Supreme Court rejected the petition of detainee
Khader Mubarak to bar the General Security Service (GSS, also known as shin
bet or shabak) from using "physical pressure" against him. He had reportedly
been deprived of sleep while handcuffed and hooded with sacking. The Supreme
Court ruled that these practices could continue, and the GSS agreed not to
further tighten Khader Mubarak's handcuffs or to force him to sit or stand
in painful positions. However, being forced to sit or stand in any one position
for many hours on end would eventually become painful.
Khader Mubarak, a Palestinian and suspected member of the military arm of the
Islamic Resistance Movement Hamas, is accused of having information about
violent attacks against Israeli targets. He was arrested on 21 October 1996
and appealed to the Supreme Court on 14 November to end "physical pressure"
during his interrogation.
This ruling follows just after a similar ruling on 14 November 1996 in which
the Israeli Supreme Court overturned an injunction against the GSS, thus
allowing them to continue to use "increased physical pressure" against Muhammad
'Abd al-'Aziz Hamdan, a suspected member of Islamic Jihad.
PLEASE CONTINUE APPEALS AS SPECIFIED IN ORIGINAL ACTION, ADDING THE NAME OF
KHADER MUBARAK TO THE FIRST RECOMMENDED ACTION.
