Poland: Briefing by Amnesty International ahead of the General Affairs Council meeting taking place on 18 September 2018

Since 2016, the state of the rule of law and independence of the judiciary in Poland has been under increased scrutiny of international human rights monitoring bodies, as well as European Union institutions. This briefing provides a summary of developments and documents Poland’s continuation of undermining the independence of the judiciary. It focuses on the impact of the amendment of the Law on the Supreme Court and the forced retirement of a third of the Supreme Court judges. It raises concerns over the politicization of the National Council of the Judiciary, a body responsible for, among other things, election of judges.
