UK: The Pinochet case: Universal jurisdiction and the absence of immunity for crimes against humanity

This paper sets forth Amnesty International’s position on three of the legal issues involved in the rehearing of the appeal to the House of Lords of the judgement by the English High Court of Justice that granted Pinochet immunity. The issues are: the immunity under Chilean law for crimes against humanity and torture committed since 1973; the scope of universal jurisdiction for these crimes; the absence of immunity under international law for heads of state for certain crimes, including crimes against humanity and torture
