Poland: Third-party intervention to the European Court of Human Rights in the case of Waldemar Żurek

Amnesty International and International Commission of Jurists submitted their third intervention to the European Court of Human Rights as part of series of cases that raise the issue of the independence of the judiciary in Poland. The case of Żurek v Poland concerns the premature termination of a judge’s mandate as a member of the National Council of the Judiciary (NCJ).

The submission covers the scope of application of Article 6.1 in cases relating to the role of self-governance bodies safeguarding the independence of the judiciary. It also presents an analysis on the scope of Article 10 as applied to judges, including those engaged in the administration of the judiciary.
