USA: Wrong court, wrong place, wrong punishment: Five alleged ‘9/11 conspirators’ to be arraigned for capital trial by military commission at Guantánamo

On 5 May 2012, a US Army Colonel is due to conduct the arraignment of five men who have been in US custody without trial for approaching a decade. This situation – indefinite detention, unfair trial, and a lack of accountability for human rights violations – is the product of the USA’s “global war” theory, adopted after the 9/11 attacks. The case could allow the USA to show its commitment to human rights. However, the USA seems set on a path that ends in justice neither being done nor being seen to be done.
