Amnesty International fears that Anatoly Vladimirovich Lyubarsky faces imminent
execution unless Leonid Kravchuk, the President of Ukraine, exercises his
constitutional authority to commute his death sentence.
Anatoly Lyubarsky was sentenced to death for murder by Vinnitsa Regional Court
on 26 October 1993. His appeal against his death sentence was rejected by
the Supreme Court of Ukraine on 13 January 1994. A petition for clemency is
believed to be still pending with the President of Ukraine. A decision could
be taken any time now.
It is impossible to determine exactly how much time elapses between the Supreme
Court of Ukraine upholding a death sentence and execution taking place because
of the authorities' persistent refusal to publish any details on procedures
surrounding the death penalty. However, judging by death penalty cases which
have come to Amnesty International's knowledge, execution is believed to take
place on average within six months of the Supreme Court turning down an appeal,
if the President does not exercise his constitutional authority to commute
the death sentence.
Amnesty International opposes the death penalty in all cases and without
reservation, on the grounds that it is a violation of the right to life and
the right not to be subjected to cruel, inhuman or degrading treatment or
punishment as proclaimed in the Universal Declaration of Human Rights.
RECOMMENDED ACTION: Please send telegrams/faxes/express and airmail letters
either in Russian, English or in your own language:
- stating Amnesty International's opposition to the death penalty in all cases;
- urging President Kravchuk to grant clemency to Anatoly Lyubarsky and to commute
his death sentence;
- urging President Kravchuk to commute all other death sentences that come
