A federal court ruling on 8 September 2010 upholding the US administration’s invocation of the “state secrets privilege” and agreeing to dismiss a lawsuit brought by five men who claim they were subjected to enforced disappearance, torture and other cruel, inhuman or degrading treatment at the hands of US personnel and agents of other governments, may end their pursuit of judicial remedy in the USA. The USA continues to fail to address its obligations on remedy and accountability for human rights violations in the counter-terrorism context.
