Lawyer Rıza Dinç has now been formally charged with membership of an illegal organisation, (Rızgari), and committed to prison. He is being held in Konya E-Type Prison, where he has been allowed access to his lawyers.

He was taken for a first court hearing at Konya State Security Court on 9 February 1995, and is due to appear at a second hearing at the same court on 9 March 1995.

Rıza Dinç reported that he was extensively tortured in police custody. He entered a formal complaint of torture at his hearing on 9 February, but no further action has been taken by the authorities regarding his allegations. He had reportedly been stripped naked and subjected to beating on the soles of the feet (falaka), hanging by the wrists with hands tied behind his back, soaking with cold water, electric shocks to the genitals, beatings and death threats.

FURTHER RECOMMENDED ACTION: Please send telegrams/faxes/express and airmail letters in English or in your own language:

- expressing concern about allegations that the lawyer Rıza Dinç was tortured while in police custody in Mersin following his detention on 30 September 1994;

- urging that a prompt, full and impartial investigation is carried out into Rıza Dinç's torture complaint submitted to Konya State Security Court on 9 February 1995; and that those responsible for the torture are brought to justice;

- asking to be informed of the results of the investigation.
