SURAN 05/92 - Ukraine: Yevgeny Vladimirovich Berestovsky
An unofficial source reports that Yevgeny Berestovsky was sentenced to death on 26 April 1991 by the regional court in Dnepropetrovsk. He had been convicted of premeditated murder under aggravating circumstances (Article 93 of the Criminal Code). The Ukrainian Supreme Court upheld the sentence on 23 July 1991. According to reports, the investigator in the case originally had sought to bring charges of premeditated murder without aggravating circumstances (Article 94, carrying a maximum sentence of 10 years in prison). However, unspecified higher authorities are reported to have compelled him to substitute the charge under Article 93. A petition for clemency is pending.
