This document is the text of a memorandum addressed by Amnesty International to the State Council (government) and National People's Congress of the People's Republic of China. It examines practices and inadequacies in the law enforcement and justice system which lead to human rights violations on a large-scale and constitute major obstacles to improving respect for the rule of law and human rights in China. These include the lack of independence of the judiciary, the existence of a system of administrative detention and the widespread use of torture.
